The Pres. is a representative of the state in foreign affairs, he ratifies and denounces international agreements, of which he notifies the Sejm and Senate. Before ratifying an international agreement, he may refer to the Constitutional Tribunal to determine its constitutionality. '''PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ''' – monokratyczny organ państwa (tzw. głowa państwa), jeden z dwóch elementów władzy wykonawczej (obok → rady ministrów). Ustanowiony na mocy konstytucji marcowej z 1921 r., zniesiony w latach 1952–1989, przywrócony na mocy noweli kwietniowej z 1989 r. W latach 1939–1990 prez. funkcjonował na emigracji w Londynie, w grudniu 1990 r. insygnia władzy prez. II RP przekazano Lechowi Wałęsie, pierwszemu prez. wybranemu w elekcji powszechnej. Tryb wyboru prez. RP był zróżnicowany – był wybierany przez: Zgromadzenie Narodowe (sejm i senat) w 1922, 1926 oraz 1933; kolegium elektorskie (nie zastosowano tego trybu); Sejm RP w 1947; ponownie Zgromadzenie Narodowe w 1989 r.; w wyborach powszechnych od listopada 1990 r. 
Prez. od 1990 r. wybierany jest przez naród w wyborach powszechnych, równych, bezpośrednich, w głosowaniu tajnym. Na urząd może być wybrany obywatel polski, który najpóźniej w dniu wyborów ukończył 35 rok życia i korzysta z pełni praw wyborczych do sejmu. Kandydata może zgłosić co najmniej 100 tys. obywateli mających prawo wybierania do sejmu. Wybrany jest kandydat, który uzyskał ponad połowę ważnie oddanych głosów; jeżeli żaden z kandydatów nie uzyska wymaganej większości, to po 14 dniach przeprowadza się ponowne głosowanie z udziałem dwóch kandydatów. Kadencja prez. wynosi pięć lat liczone od momentu złożenia przysięgi przed Zgromadzeniem Narodowym. Prez. ma prawo do jednorazowej reelekcji. 
Prez. RP jest wyposażony w kompetencje: względem sejmu i senatu (zarządzanie pierwszego posiedzenia izb parlamentu, zarządzanie daty wyborów, skrócenie kadencji sejmu i senatu w konstytucyjnie określonych okolicznościach, prawo inicjatywy ustawodawczej, prawo zwrotu ustawy do sejmu w celu ponownego rozpatrzenia); względem rady ministrów (prawo uczestniczenia w posiedzeniach rządu, zwoływania rady gabinetowej, powoływania rady ministrów, dymisjonowania rady ministrów w określonych konstytucyjnie sytuacjach, odwoływania ministra po udzieleniu mu wotum nieufności w sejmie lub na wniosek premiera); względem władzy sądowniczej (powoływanie sędziów, pierwszego prezesa Sądu Najwyższego, prezesa i wiceprezesa Trybunału Konstytucyjnego, prezesa Naczelnego Sądu Administracyjnego). Prez. mianuje członków Rady Polityki Pieniężnej, członków Rady Bezpieczeństwa Narodowego, dwóch członków Krajowej Rady Radiofonii i Telewizji. Prez. składa do sejmu wniosek o powołanie prezesa Narodowego Banku Polskiego. Nadaje statut Kancelarii Prezydenta RP i powołuje jej szefa. Prez. RP wydaje rozporządzenia i zarządzenia na zasadach określonych konstytucyjnie. RP współdziała z radą ministrów (premierem i odpowiednim ministrem). Mianuje i odwołuje pełnomocnych przedstawicieli RP w innych państwach i przy organizacjach międzynarodowych. Prez. nie podlega odpowiedzialności politycznej, ponosi jedynie odpowiedzialność konstytucyjną za naruszenie przepisów konstytucji lub ustaw. Wniosek powyższy wymaga przegłosowania 2/3 głosów ustawowej liczby członków Zgromadzenia Narodowego, o naruszeniu konstytucji lub ustaw orzeka Trybunał Stanu. In December 1990 the insignia of power of the Pres. of the Second Republic of Poland were handed over to Lech Wałęsa, the first Pres. chosen in general elections. The mode of selection of the Pres. of the Republic of Poland was diverse – the president was elected by: the National Assembly (the Sejm and Senate) in 1922, 1926 and 1933; electoral college (this mode was not used); the Sejm of the Republic of Poland in 1947; again by the National Assembly in 1989; in the general elections since November 1990.
Since 1990 the Pres. is elected by the nation in universal, equal and direct elections, conducted by secret ballot. Only a Polish citizen who, no later than the day of the elections, has attained 35 years of age and has a full electoral franchise in elections to the Sejm, may be elected president. The candidate can be proposed by at least 100,000 citizens having the right to vote in elections to the Sejm.
